Terms and Conditions

Good Day,

Just wanted to let everyone know that we have issued a revised version of the terms and conditions. This isn't going to change how Constant-Content functions or operates. We've just tried to move the terms and conditions into something where everyone has a more sure footing to stand on. The new terms and conditions are available at http://www.constant-content.com/about/t ... itions.htm I encourage everyone to go read them.

The format has changed, but aside from a number of specific changes that we have had to make as the site has changed hands (jurisdiction, notice, etc.), the spirit of the terms and conditions remains the same. We want this to be an great place for writers to hone their skills and ply their trade. We're committed to creating a great site to write and sell unique content.

I am a little confused. There are statements regarding the Author's web site and all promotional or marketing materials of the author in the Terms and Conditions. Are you referring to web site and materials that is the property of Constant Content or to all web sites that are owned by an author elsewhere? Since people exercise freedom of speech on sites like blogs, I can see where this wording might be a problem.

Hi audrabianca,

This only applies to works that are uploaded to Constant-Content. It mentions this in the parent bullet D.2 where it says " At the time a Work is uploaded to the Website, the Author represents and warrants to Constant-Content and further covenants that: "

I think that you're looking at section D.2.2 where it says (please correct me if I'm wrong)
"neither the Works nor any web site or other promotional or marketing material of the Author will contain any content which in the opinion of Constant-Content is or may be construed as being defamatory, obscene, pornographic, misleading, deceptive, fraudulent or otherwise inappropriate, or otherwise contravene the Can-Spam Act of 2003 (United States) or other similar legislation applicable either to the Author or to Constant-Content;"

We certainly recognize everyone's right to free speech and also entirely recognize that you are free to post and publish on any other sites anything that you would like.

But I agree that this is could be made a little more clear. I'll look into rewording this clause to make it more clear.

If I totally missed the boat on the section you're referring to please let me know.
