Just to make it crystal clear, you have no protection at all. Don't invest more time in a private request than you are willing to lose. I sold one of my unclaimed ones for pretty close to the negotiated price to someone else, so at least there is that option... assuming that the articles are general enough that someone else might be interested.

I'm not taking them anymore unless I think the article has enough general interest that it will sell anyway, even if the client flakes, or if I think it will be fun and I can whip it out with little effort.
