Relocation Issues

Summary:
An article outlining the issues and considerations parents need to think about before petitioning for permission to move away with their children.
Details or Sample:
Sometimes when parents are separated or divorced, they live close to each other, and the children can spend a lot of time with each parent. What happens when one parent wants to move away with the child? What if you"re now married to someone who gets transferred out of state and you want to move with them and take your children, but the other parent says no?

In most cases, you may file a petition to the court asking the court"s permission to move with the children. The court will schedule a hearing to talk about the best interests of the children. The "best interests" will most often be the bottom line in deciding whether the children are allowed to move.

The court can"t tell you that you can"t move; as an adult you have the right to live wherever you want. However, the court can say the children will stay, and custody may be transferred to the parent who remains behind.
