Searching for Court of Appeals Records in Ohio's Second District

The Second Appellate District in the State of Ohio provides services for six different Ohio counties. The counties in the Second District are Champaign, Clark, Darke, Greene, Miami and Montgomery.
Any time a party appeals a case from a lower court in one of these six Ohio counties, the case falls under the review of the Second District Court of Appeals. Since the appellate judges need to review the entire record from the case below as well as appellate briefs filed by the parties, the lower court’s case file will be given to the judges for review as well. Therefore, the file ultimately reviewed by the appellate judges will not only include the notice of appeal that initiated the appeal and the appellate briefs filed by the parties, it will also include all pleadings, motions, written discovery, entries and orders that were filed in the case below. Additionally, if the matter went to trial rather than being decided by motion, the file will likely include the evidence entered at trial that was entered into the record, as well as a transcript of the trial. In rare cases, court records may be sealed for various reasons. If this is not the case, the records of the Second District Court of Appeals are matters of public record and may be reviewed by members of the public during normal court hours.
Unfortunately, it is not possible to view documents from a court of appeals record in their entirety online, except for the final opinion rendered by the appeals court, and lower court documents from Montgomery County cases. If you wish to read any other document in the file, it will be necessary to access the court record in person. Since the Second District Court of Appeals services multiple counties, it is a good idea to verify the location of the file before traveling to view it. At the time of the writing of this article, the Second District Court of Appeals does not maintain an extensive website. It does maintain an online docket to allow viewers to learn when oral arguments will be heard on certain cases. This docket may be accessed through a link found on the page of the Ohio Supreme Court website referenced above.
Although the Second District Court of Appeals does not maintain an online database of its cases, Clark, Greene and Montgomery Counties do maintain searchable databases. Montgomery County’s database has the added advantage of offering scanned documents to be viewed online. Fortunately, the final decisions made by all Ohio courts of appeals are maintained in a searchable database made available online by the Ohio Supreme Court.
